Duties and powers
1. Submit to the People's Committee , Chairman of the People's Committee at district level to issue decisions, directives; long-term, five-year and annual plans; programs and measures to organize the implementation of state administrative reform tasks in the assigned state management fields.
2. Organize the implementation of legal documents, planning, and plans after approval; provide information, propaganda, dissemination, education, and monitor law enforcement in areas within the assigned management scope.
3. About organization and apparatus:
a) Submit to the People's Committee , Chairman of the People's Committee at district level to issue documents specifying the functions, tasks, powers and organization of the Department of Home Affairs according to regulations and instructions of the People's Committee at provincial level;
b) Advise and assist the District People's Committee to submit to competent authorities for decisions on the establishment, merger, separation, and dissolution of specialized agencies under the District People's Committee ;
c) Appraisal of the content of draft documents regulating the functions, tasks, powers and organization of specialized agencies and public service units under the People's Committee at the district level;
d) Appraise projects on establishment, reorganization, and dissolution of public service units under the decision-making authority of the District People's Committee according to the provisions of law and the decentralization of the Provincial People's Committee;
d) Advise and assist the District People's Committee in submitting to the Provincial People's Committee decisions on the establishment, reorganization, and dissolution of public service units under the District People's Committee in accordance with the provisions of specialized laws;
e) Appraise the establishment, consolidation, merger and dissolution of inter-sectoral coordination organizations under the decision-making authority of the Chairman of the District People's Committee according to the provisions of law.
4. Regarding management and use of public employee payroll and number of employees in public service units:
a) Appraise and submit to the District People's Committee and the Chairman of the District People's Committee the annual plan for public employee payroll and number of employees of public agencies and units under the management authority of the District People's Committee for the District People 's Committee to submit to the Provincial People's Committee according to regulations;
b) Submit to the Chairman of the District People's Committee to assign civil servant payroll and the number of employees in public service units after approval by competent authorities;
c) Assist the District People's Committee in guiding and inspecting the management and use of civil servant payrolls and the number of employees in public service units according to the provisions of law;
d) Synthesize and report on civil servant payrolls and the number of employees in administrative agencies, organizations, and public service units according to the provisions of law.
5. Regarding management of job positions and structure of civil servant and public employee titles:
a) Submit to the District People's Committee to issue documents directing and guiding agencies, organizations and units under the District People's Committee to manage and develop projects on job positions, structure of civil servant and public employee titles or projects on adjusting job positions, structure of civil servant and public employee titles according to the provisions of law and according to the direction and guidance of the Provincial People's Committee ;
b) Assist the District People's Committee in urging, monitoring, appraising, and synthesizing the development of job position projects, the structure of civil servant and public employee titles, or projects to adjust job positions, the structure of civil servant and public employee titles in agencies, organizations, and units under the management authority of the District People's Committee for submission to the Provincial People's Committee for appraisal; assist the District People's Committee in synthesizing the list of job positions, the structure of civil servant and public employee titles of the district for submission to the Provincial People's Committee according to regulations;
c) Submit to the District People's Committee to implement the use and management of job positions and the structure of civil servant and public employee titles in agencies, organizations and units under the District People's Committee according to regulations, decentralization or authorization of the Provincial People's Committee .
6. On government building work:
a) Advise and assist the People's Committee at the district level in organizing and guiding the election of National Assembly deputies and People's Council deputies at all levels in the area according to the provisions of law and instructions of the People's Committee at the provincial level;
b) Assist the District People's Committee in submitting to the District People's Council the election, dismissal, and removal of the Chairman, Vice Chairman and other members of the District People's Committee in accordance with the provisions of law;
c) Submit to the Chairman of the District People's Committee for approval of election results, approval of dismissal and removal of members of the Commune People's Committee according to regulations. Submit to the Chairman of the District People's Committee for appointment and reappointment of the positions of Chairman, Vice Chairman, and members of the Commune People's Committee where the pilot program of not organizing a People's Council is implemented according to regulations;
d) Assist the District People's Committee in submitting to the Chairman of the Provincial People's Committee for approval of election results, approval of dismissal and removal of members of the District People's Committee according to the provisions of law;
d) Assist the District People's Committee in submitting to the Chairman of the Provincial People's Committee the appointment and reappointment of the positions of Chairman, Vice Chairman, and members of the District People's Committee where the pilot program is implemented without organizing a People's Council according to regulations;
e) Develop and submit to the District People's Committee projects related to the establishment, dissolution, merger, division, adjustment of administrative unit boundaries, renaming of administrative units , and classification of administrative units in the area for the District People's Committee to submit to competent authorities for consideration and decision;
g) Advise and assist the District People's Committee in guiding and organizing the implementation of projects and documents related to administrative boundary work and classification of administrative units after approval by competent authorities;
h) Assist the District People's Committee in managing records, landmarks, boundaries, and administrative boundary maps of the district according to the provisions of law;
i) Advise and assist the People's Committee at the district level in guiding, inspecting, synthesizing, and reporting on the implementation of laws on democracy in communes, wards, and towns, in administrative agencies, public service units, and enterprises in the area and the implementation of mass mobilization work by the government according to regulations;
k) Advise and submit to the People's Committee at the district level on guiding the establishment, dissolution, merger, and inspection, synthesis, and reporting on the activities of villages and residential groups in the district according to regulations; conduct training for heads and deputy heads of villages and residential groups according to regulations;
l) Advise and assist the District People's Committee in directing, guiding and inspecting the Commune People's Committee in developing and implementing documents and projects related to new rural construction as assigned by the District People's Committee and in accordance with the provisions of law.
7. Regarding cadres, civil servants, and public employees; commune-level cadres, civil servants, and non-professional workers at the commune level:
a) Submit to the Chairman of the District People's Committee for decision on recruitment, use, management of job positions, transfer, appointment, reappointment, resignation, rotation, secondment, reward, discipline, evaluation, termination, retirement, implementation of salary regime, welfare regime and other regimes and policies for cadres, civil servants and public employees under the management authority of the District People's Committee according to the provisions of law and decentralization of the Provincial People's Committee ;
b) Carry out the work of managing records, training, fostering professional expertise, and management knowledge for cadres, civil servants, public employees, and commune-level cadres and civil servants according to the provisions of law, according to the management decentralization of the Provincial People's Committee and the guidance of the Department of Home Affairs;
c) Assist the District People's Committee in recruiting and managing commune-level civil servants; implementing regimes and policies for commune-level cadres, civil servants and part-time workers at the commune level according to regulations.
8. On administrative reform, reform of the civil service and civil servant regime:
a) Submit to the District People's Committee to deploy, urge and inspect specialized agencies at the same level and the Commune People's Committee to carry out administrative reform, reform of the public service and civil servant regime in the locality;
b) Submit to the District People's Committee measures to promote administrative reform, promote reform of the civil service and civil servant regime in the district;
c) Carry out the work of synthesizing and reporting on administrative reform, reform of the public service and civil servant regime at the local level according to regulations.
9. Assist the District People's Committee in performing state management of the organization and operation of associations, social funds, and charity funds in the area in accordance with the provisions of law and under the authorization of the Chairman of the Provincial People's Committee .
10. Regarding document and archive work:
a) Guide and inspect the implementation of the State and provincial regulations on documents and archives for agencies and organizations at district and commune levels according to the provisions of law;
b) Carry out reporting and statistical work on documents and archives according to the provisions of law.
11. Regarding emulation and reward work:
a) Advise and propose to the District People's Committee to organize emulation movements and implement the Party and State's reward policies in the district; perform the permanent duties of the District Emulation and Reward Council;
b) Guide, inspect and urge the implementation of emulation and reward plans and contents in the district; build, manage and use the Emulation and Reward Fund according to the provisions of law.
12. On religious work:
a) Assist the District People's Committee in directing, guiding, inspecting and organizing the implementation of the Party's guidelines, policies and laws of the State on religion and religious work in the area;
b) Preside over and coordinate with specialized agencies at the same level to perform state management tasks on religion in the area according to the decentralization of the Provincial People's Committee and according to the provisions of law;
c) Advise and assist the People's Committee at the district level in resolving specific religious issues in accordance with the provisions of law and under the guidance of the Department of Home Affairs.
13. On youth work:
a) Organize the implementation of legal documents, strategies, programs, plans for youth development and youth work;
b) Guide, propagate, disseminate, and educate on laws on youth and youth work according to regulations; resolve issues related to youth and youth work according to regulations and decentralization;
c) Preside over and coordinate with relevant agencies and other youth organizations in implementing or proposing competent authorities to implement mechanisms and policies for youth and youth work according to regulations.
14. Submit to the District People's Committee to issue documents guiding internal affairs in the area; provide professional and technical guidance on internal affairs for agencies and units at the district level and the Commune People's Committee.
15. Carry out inspections, resolve complaints, handle according to authority or report to competent authorities to handle violations of internal affairs in the district according to regulations. Carry out anti-corruption work, practice thrift, combat waste according to law and assignment of the District People's Committee .
16. Carry out statistical work, information, and report to the Chairman of the District People's Committee and the Director of the Department of Home Affairs on the situation and results of implementing home affairs work in the area.
17. Organize the implementation and application of scientific and technological advances; build information and storage systems to serve state management of internal affairs in the area.
18. Manage job positions, civil servant payroll, and civil servant rank structure in the Department of Internal Affairs according to the provisions of law.
19. Manage and be responsible for the finances and assets of the Department of Internal Affairs according to the provisions of law and as assigned by the District People's Committee .
20. Assist the District People's Committee in specifying the functions, tasks and powers of the Commune, Ward and Town People's Committees on internal affairs and other assigned areas of work based on the provisions of law and guidance of the Department of Home Affairs.
21. Perform other tasks assigned by the District People's Committee or as prescribed by law.
Organization and staffing
1. The Department of Internal Affairs has a Head of Department, no more than 03 Deputy Heads of Department and civil servants performing professional and technical work:
a) The Head of the Department of Home Affairs is responsible to the District People's Committee , the Chairman of the District People's Committee and before the law for the performance of assigned functions, tasks, powers and all activities of the Department of Home Affairs;
b) The Deputy Head of the Internal Affairs Department assists the Head of the Department in charge of and monitors certain aspects of work; is responsible to the Head of the Department and before the law for assigned tasks. When the Head of the Department is absent, a Deputy Head of the Department is authorized by the Head of the Department to manage the activities of the Department;
c) The appointment, reappointment, transfer, secondment, evaluation, reward, discipline, dismissal, resignation and implementation of other regimes and policies for the Head and Deputy Head of the Department of Internal Affairs shall be decided by the Chairman of the District People's Committee according to regulations.
2. Staff:
a) The civil servant establishment of the Department of Home Affairs is decided by the Chairman of the District People's Committee within the total civil servant establishment of the district approved by the competent authority;
b) The assignment of work to civil servants of the Department of Internal Affairs must be based on the job position, civil servant rank standards, and the qualities, qualifications, and abilities of the civil servant.
