Duties and Powers
1. Submit to the People's Committee at the district level for promulgation of decisions and directives; long-term, 5-year and annual plans and planning on the judicial sector; programs and measures to organize the implementation of administrative reform and judicial reform tasks, and to develop and perfect laws on areas within the decision-making authority of the People's Council and the People's Committee at the district level in the judicial sector .
2. Submit to the Chairman of the District People's Committee draft documents on the judicial field under the authority of the Chairman of the District People's Committee.
3. Organize the implementation of legal documents, planning and plans in the judicial field after approval by competent authorities.
4. Directing, guiding, and inspecting professional expertise in judicial work at the commune level.
5. On drafting legal documents:
a) Coordinate the development of decisions and directives under the authority of the District People's Committee, which are developed by other specialized agencies under the District People's Committee;
b) Appraise draft legal documents under the promulgation authority of the People's Council and People's Committee at district level; provide comments on draft legal documents of the People's Council at district level according to the provisions of law;
c) Organize public consultation on draft laws and ordinances under the direction of the District People's Committee and guidance of the Department of Justice.
6. Regarding law enforcement monitoring:
a) Develop and submit to the District People's Committee for promulgation and implementation of the Plan to monitor the implementation of law enforcement in the area;
b) Guide, urge and inspect specialized agencies under the People's Committee at the district level and specialized civil servants under the People's Committee at the commune level in monitoring the implementation of laws in the locality;
c) Synthesize and propose to the District People's Committee on handling the results of monitoring the implementation of the law;
d) Monitor the implementation of laws in the judicial field under the state management of the People's Committee at the district level.
7. Regarding checking legal documents:
a) Assist the People's Council and People's Committee at the district level in self-inspecting documents issued by the People's Council and People's Committee at the district level; guide professional civil servants of the People's Committee at the commune level in self-inspecting legal documents issued by the People's Committee at the commune level;
b) Conduct inspection of legal documents of the People's Council and People's Committee at the commune level according to the provisions of law; submit to the Chairman of the People's Committee at the district level to decide on measures to handle illegal documents according to the provisions of law.
8. Organize the implementation of the review and systematization of legal documents of the People's Council and the People's Committee at the district level according to the provisions of law; urge, guide, and synthesize the results of the review and general systematization of specialized agencies under the People's Committee at the district level and of the People's Committee at the commune level.
9. Regarding administrative procedure control:
a) Organize the implementation of administrative procedure control tasks under the direction of the District People's Committee, guidance of higher-level judicial agencies and according to legal regulations on administrative procedure control;
b) Advise the People's Committee at the district level to direct and organize the review and assessment of administrative procedures implemented in the district to recommend and propose amendments, supplements, cancellations, and abolitions;
c) Guide, urge and inspect the implementation of public posting of administrative procedures, report on the situation and results of handling administrative procedures and receive and handle feedback and recommendations on administrative regulations of district-level professional agencies and commune-level People's Committees.
10. On dissemination, legal education and mediation at the grassroots level:
a) Develop and submit to the District People's Committee for promulgation programs and plans for dissemination and education of law and organize implementation after the programs and plans are promulgated;
b) Monitor, guide and inspect the dissemination and education of law in the locality; urge and inspect specialized agencies under the People's Committee at the district level, relevant agencies and organizations and People's Committees at the commune level in organizing the Law Day of the Socialist Republic of Vietnam in the locality;
c) Perform the tasks of the standing body of the District-level Council for Coordinating the Dissemination and Education of Law;
d) Build and manage a team of legal reporters and legal propagandists according to the provisions of law;
d) Guide the construction, management and exploitation of law bookcases at the commune level and in other agencies and units in the area according to the provisions of law;
e) Organize the implementation of legal provisions on mediation at the grassroots level.
11. Appraise draft village and residential group covenants and regulations before submitting them to the Chairman of the District People's Committee for approval.
12. Assist the District People's Committee in performing the task of building communes, wards and towns to access the law according to regulations.
13. Regarding household registration and management:
a) Direct and inspect the organization and implementation of civil status registration and management in the area; organize training in civil status management and registration for civil status officials at the commune level;
b) Assist the District People's Committee in performing civil status registration in accordance with the provisions of law; request the District People's Committee to decide on the revocation and cancellation of civil status papers issued by the Commune People's Committee in violation of the provisions of law (except in cases of illegal marriage);
c) Manage, update, exploit the electronic civil status database and issue copies of civil status extracts according to regulations;
d) Manage and use the Family Register Book and family registration forms; store the Family Register Book and family registration records according to the provisions of law.
14. Perform management tasks on adoption according to the provisions of law.
15. About authentication:
a) Provide professional guidance and inspection to specialized civil servants of the People's Committees at the commune level in issuing copies from original books, certifying copies from originals, and certifying signatures;
b) Issue copies from original books, certify copies from originals, and certify signatures in accordance with the provisions of law.
16. Regarding state compensation:
a) Propose and submit to the People's Committee at the district level to determine the agency responsible for compensation in case the damaged person requests or there is no consensus on determining the agency responsible for compensation according to the provisions of law;
b) Guide the People's Committees at the commune level to carry out compensation settlement;
c) Provide information and procedural guidance to support victims in exercising their right to claim compensation in administrative management activities;
d) Monitor, urge and inspect the settlement of compensation, payment of compensation and implementation of refund responsibilities according to the provisions of law in cases where the People's Committee at the commune level is responsible for settling compensation.
17. Perform legal aid duties as prescribed by law.
18. Regarding the management of law enforcement on handling administrative violations:
a) Assist the People's Committee at district level in monitoring, urging, inspecting and reporting on law enforcement on handling administrative violations in the locality;
b) Propose to the Provincial People's Committee to recommend competent authorities to study and handle administrative violation handling regulations that are not feasible, not suitable to reality, or overlap or contradict each other;
c) Provide professional guidance in implementing laws on handling administrative violations;
d) Conduct statistics on administrative violation handling within the scope of local management.
19. Assist the District People's Committee in performing its duties and powers in enforcing civil and administrative judgments in accordance with the provisions of law and regulations on coordination between judicial agencies and local civil judgment enforcement agencies issued by the Ministry of Justice.
20. Organize training and professional development in state management of judicial work for commune-level Justice - Civil Status officials, other relevant organizations and individuals according to the provisions of law.
21. Organize the application of science and technology; build information and storage systems to serve state management in areas under the management of the Department.
22. Carry out information, statistics, and periodic and ad hoc reporting on the implementation of assigned tasks according to regulations of the District People's Committee and the Department of Justice.
23. Preside over and coordinate with relevant agencies to inspect and participate in inspecting the implementation of laws in the management fields of organizations and individuals in the area; resolve complaints and denunciations; prevent and combat corruption and waste in judicial activities in the area according to the provisions of law and the assignment of the District People's Committee.
24. Manage the organizational structure, job positions, civil servant payroll, civil servant rank structure, implement salary regimes, policies, incentives, rewards, disciplines, training and professional development for civil servants under the management scope of the Department according to the provisions of law, as assigned by the People's Committee at the district level.
25. Manage and be responsible for the assets and finances of the Department according to the provisions of law and the assignment of the District People's Committee.
26. Perform other tasks assigned by the District People's Committee or as prescribed by law.
